Bulk SMS is the term used to describe the sending of a single text message to multiple users. It could be used to refer to a hundred messages or a million although we generally think in terms of bulk messaging referring to tens of thousands of messages at least. There can be some customisation of the message, a bit like a mail merge, where name and other personalised details can be blended into a standard message template.

Because of its nature bulk SMS is most used for mass marketing, sending out special offers, discount coupons or important news to an opted in SMS mailing list. It can also be used to send out alerts – bad weather, road closures, equipment failure and so forth. A key element is usually fast delivery and reliability of delivery. You want to be sure the information is received quickly rather than arriving after the event, or worse still, not at all.

81% of mobile phone users use SMS or text messaging and 90% read text messages within three minutes of receipt. But it's not just a convenient way to chat with friends, fix a rendez-vous or remind people to do things; it has also become a powerful marketing tool for businesses large and small, national or global.

Yet another company (Quigley and Carter Limited) have been fined by the ICO for not having permission to send SMS messages. In this case, they had outsourced their marketing to a third party who then sent messages on their behalf. So is staying compliant with the regulations regarding SMS messaging so difficult? It doesn’t have to be.

Just for fun, I asked people in a marketing focused Facebook group to share the worst SMS marketing messages they’ve ever received. I was expecting a deluge of responses, but actually only a few trickled in. But those horrible SMS marketing messages are out there…the comments on my post proved it even if no one wanted to share (I guess they’re all shy).

This week I’m stuck on the same topic, but from a totally different angle: what we can learn from that failure. Because honestly, their biggest issue might not be violating the law. It might be the people they have writing their SMS messages. It’s time to dissect the message that spawned the law suit, and learn what we can from it.
